Miranda Warning Free Essay, Term Paper and Book Report
The Miranda Warning was a result of a 1966 Supreme Court decision involving Ernesto Miranda. Mr. Miranda was arrested in Phoenix Arizona and accused of kidnapping and raping a young woman. The woman identified Mr. Miranda as the offender and the police interrogated him for over two hours. Mr. Miranda signed a confession that helped get him convicted. The Supreme Court ruled that Mirandas conviction was unconstitutional because the entire aura and atmosphere of police interrogation without notification of rights and an offer of assistance of counsel tends to subjugate the individual to the will of his examiner. (Schmalleger, 2005 pg 304.)
As a result of that decision anyone who is arrested for a crime and questioned his required to be advised of his/her right to remain silent, right to counsel, and are told what they say can and will be used against them.
