March 8, 2006 Disparate Impact/Disparate Treatment Title VII prohibits employers from treating applicants or employees differently because of their membership in a protected class. The central issue is whether the employer's actions were motivated by discriminatory intent, which may be proved by either direct or circumstantial evidence. Disparate Impact means that an employer tried to implement a policy that is fair and is applied fairly, but �ends up discriminating against one or more protected classes of individuals� (hr-guide). Any employer can be caught in that situation and not even realize what had happened until the lawsuit comes. Here are some examples of what to look for in a disparate impact case, there may be a written test given, educational requirements, or height and weight requirements.
