In the United States 38 states are capital punishment states. Which means that if someone is convicted of a Capital Offense in one of these states the prosecutor can and very likely will ask for the death penalty. The Federal Death Penalty act of 1994 was enacted as Title VI of the Violent Crime Control and Law Enforcement Act of 1994, and it became effective September 13, 1994. Under that act, the offenses fall into 3 broad categories: (1) homicide offenses (2) espionage and treason (3) non-homicidal narcotics offenses.
