Family and Medical Leave Act (FMLA) The U.S. Department of Labor's Employment Standards Administration, Wage and Hour Division, administers and enforces the Family and Medical Leave Act (FMLA) for all private, state and local government employees, and some federal employees. Most Federal and certain congressional employees are also covered by the law and are subject to the jurisdiction of the U.S. Office of Personnel Management or the Congress. (Fact Sheet #28 2005) In the late 90’s and early 90’s, congress recognized that an increasing number of children were being raised in situations where both parents worked outside the home. Also, the idea of starting a family, or expanding the family was complicated by the fact that both parents’ and/ or single parents worked. After eight years of Congressional debates, thirteen votes, and two vetoes by George Bush, The Family and Medical Leave Act, 29 U.S.C. §§2601 et seq was signed by President Bill Clinton February 5th 1993 (The FMLA Handbook 2005).
