1. Prelude The Constitution is the supreme norm in a country. All national institutions should be found by the Constitution, which should be the standard of interpreting every legal order. However, the Korean Constitution has been a decoration under the long dictatorship. Although the Korean Constitution proscribed various basic rights and regulated the separation of the three powers—administrative, legislative and judicial–it has been a nominal proclamation and has not worked so much. The formation of an independent South Korean republic in 1948, the term constitutionalism has become a major focus of political strife. Although the concept has been interpreted in various ways, there has been at least a nominal consensus that constitutionalism would foster, if not guarantee, a general framework for benevolent and effective government. The constitution would help protect certain individual rights and provide safeguards against the concentration of power in the hands of a dictatorial group.
