2nd Amendment Pros and Cons The Second Amendment to the U.S. Constitution says as follows: 1."A well regulated Militia, 2.being necessary to the security of a free state, 3.the right of the people to keep and bear Arms, 4.Shall not be infringed." The federal courts have defined the Second Amendment as: 1. not applying to the states, 2. a collective vice individual right, 3. pertaining to the militia, and 4. protecting only those situations where it can be proved that an individual possessing a firearm has some relevance to a well-regulated militia. The first part of this definition is based upon two Supreme Court decisions, U.S. v. Scrimshank (1876) and Presser v. Illinois (1886).
