THE DEATH PENALTY The death penalty is something that is done quite frequently. Whether it should or shouldn�t be a resolution to a problem is a matter of opinion. There are many reasons for it to be done and not to be done. History: The death penalty is not something that Americans just came up with by themselves, many people contributed to it. The first death penalty laws date back to the Code of Hammaurabi and Hittites Code. It was also enforced in the �Draconian Code of Athens, which made death the only punishment for all crimes�. Fortunately, that all crimes aren�t punishable by execution in America or else our population would be much smaller. In �Fifth Century B.C.�s Roman Law of the Twelve Tablets, death was carried out by such means as crucifixion, drowning, beating to death [and] burning alive.� These are things that are considered cruel and unusual in the United States.
