Should we abolish the No Fault Divorce Free Essay, Term Paper and Book Report

In America today, nearly half of every couple married will end in divorce. Nearly one million children are touched by divorce each year. Of the one million children, 40% have not seen the father in one year. Should divorce in America be so easy? Should Alabama abolish the no-fault divorce? In this paper I plan to explain what a no-fault divorce is exactly and explain both sides of the argument. No-fault divorce started in California with the passage of the Family Law Act of 1969, signed by the then governor, Ronald Regan on September 4, 1969. The Family Law Act took effect on January 1, 1970. The Family Law Act abolished the common law and replaced it with no-fault. In common law, to end a marriage, one spouse had to prove the other spouse guilty in a court of law of one of the following; adultery, abandonment for one year, imprisonment, crimes against nature man or beast; drug addiction; drunkenness; or mental illness (Ala. Code ~ 30-21). A no-fault divorce is one in which neither spouse blames the other for the breakdown of the marriage. Both spouses agree that irreco......
