Is Flag Burning protected under the First Amendment? Free Essay, Term Paper and Book Report

There is a lot of controversy involving this topic. On June 21, 1998 the Supreme Court ruled that the act of flag burning is protected by the First Amendment. President George H. W. Bush boycotted the decision and asked for an amendment that would abolish it. Congress in turn passed a federal law that would make it a crime to burn or deface a US flag. In June 1990 the Supreme Court yet again declared the law unconstitutional (Burns et al, 2004, p.413). So what are people supposed to believe is right? Flag burning is very controversial because people have different definitions of what “freedom of speech” means and what our flag stands for. This paper explores these definitions from the proponent’s view point for a law protecting the flag and the opponents view point against such a law. The most debated question being asked at this time is: is flag burning protected under the First Amendment guaranteeing the freedom of speech?
